NTFSA's manual in terms of section 51 of the Promotion of Access to Information Act, explaining the records we hold and how to request access.

This manual is published in terms of section 51 of the Promotion of Access to Information Act 2 of 2000 ("PAIA"). PAIA gives effect to the constitutional right of access to information held by another person where that information is required to exercise or protect any right.

The Information Regulator has compiled a guide, in terms of section 10 of PAIA, on how to use the Act. It is available, in each official language, from the Information Regulator at the contact details above.
4.Records held by NTFSA
NTFSA holds records in, among others, the following categories. Holding a record does not mean access will automatically be granted; requests are assessed against PAIA's grounds for refusal.
- Governance & corporate — constitutional and registration documents, policies and minutes.
- Membership — application, registration and correspondence records.
- Financial — accounting, banking, tax and audit records.
- Partners & providers — agreements with insurers, funders and investment providers.
- Personnel — employee and contractor records.
- Operational & IT — systems, website and information-security records.
- Marketing — communications and member-education materials.
Records are also kept in terms of other legislation, which may include the Companies Act, the Income Tax Act and Value-Added Tax Act, the Basic Conditions of Employment Act, the Financial Intelligence Centre Act and POPIA.
5.Records available without a formal request
Certain information — such as the content of this website and material we publish for members — is freely available and does not require a PAIA request.
6.How to request access
To request a record, complete the prescribed Form 02 (Request for Access to Record of Private Body) and send it to the Information Officer at info@ntfsa.co.za or the address above. Your request should:
- Provide enough detail to identify the record and the requester.
- Identify the right you are seeking to exercise or protect and explain why the record is required.
- State the form of access and how you wish to be notified of the outcome.
- Include proof of identity, and proof of authority if you are acting for someone else.
7.Fees
PAIA provides for a request fee and, where access is granted, an access fee calculated according to the prescribed tariffs in the PAIA Regulations (covering reproduction, search and preparation, and postage). We will notify you of any fee payable before processing the request.
8.Decision and timeframes
We will ordinarily decide on a request within 30 days of receiving it, and notify you of the outcome and any fee. This period may be extended in the circumstances allowed by PAIA, in which case we will inform you.
9.Grounds for refusal
Access may be refused on the grounds set out in PAIA, which include the mandatory protection of the privacy of a third party, the commercial information of a third party or of NTFSA, confidential information, and records privileged from production in legal proceedings.
10.Remedies
If your request is refused, you may lodge a complaint with the Information Regulator or apply to court, as provided for in PAIA.
11.Requesting your own personal information (POPIA)
If you simply want to access or correct your own personal information, you may also make a request under POPIA using Form 2, addressed to our Information Officer. See our Privacy Policy.
12.Availability of this manual
This manual is available on this website and, on request, at our offices and from the Information Regulator. We review and update it as required.
